Terms of Service

Shift Tracker is operated by Rouge Industries LLC ("we", "us", or "our"), trading as "Shift Tracker". By creating an account or using the service, you enter into a binding agreement with Rouge Industries LLC.

By accessing or using Shift Tracker, you agree to be bound by these Terms. If you do not agree, do not use the service. Continued use after changes are posted constitutes acceptance of the revised Terms.

You confirm you are at least 13 years old (or the minimum age of digital consent in your country) and, if using on behalf of an organization, that you have authority to bind that organization.

Shift Tracker provides tools for hockey and lacrosse players to log, visualize, and analyze game statistics, including wearable device integration and team roster features for paid subscribers.

You agree not to misuse the service. In particular, you will not:

• Use the service for unlawful, fraudulent, or abusive purposes;
• Infringe anyone's intellectual property or privacy rights;
• Upload malware, attempt to probe or compromise our systems, or scrape data without permission;
• Resell, redistribute, or sublicense the service without our written consent;
• Reverse engineer or circumvent technical limits of the service.

You are responsible for keeping your account credentials confidential and for all activity under your account. Provide accurate information and keep it up to date.

Rouge Industries LLC retains all right, title, and interest in and to Shift Tracker, including its software, design, branding, documentation, and content we provide. We grant you a limited, non-exclusive, non-transferable, revocable right to use the service for personal or internal team use under your selected plan.

You retain ownership of the stats, notes, and other content you upload. You grant Rouge Industries LLC a limited license to host, store, and process that content solely to provide the service to you.

Paid plans are sold on a recurring subscription basis (e.g. monthly). Fees are charged in advance and renew automatically until you cancel. Prices are shown on our pricing page and may change with notice.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms in addition to these Terms. Refunds are also covered by our 30-day refund policy.

We may suspend or terminate your access to the service if you materially breach these Terms, fail to pay applicable fees, pose a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the service and delete your account at any time.

On termination, your right to use the service ends. We will delete your account data within 30 days, except where retention is required by law.

The service is provided "as is" and "as available". Rouge Industries LLC does not guarantee uninterrupted, error-free, or fully secure operation. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

To the fullest extent permitted by law, Rouge Industries LLC's aggregate liability arising out of or relating to the service is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law (e.g. fraud, death, or personal injury caused by negligence).

You agree to indemnify and hold Rouge Industries LLC harmless from any claims, damages, or expenses arising from your content, your use of the service in breach of these Terms, or your violation of any law or third-party right.

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Disputes will be brought exclusively in the state or federal courts located in Delaware, unless otherwise required by mandatory local law.

We may update these Terms from time to time. Material changes will be announced in the app or by email. The "Last updated" date above reflects the latest revision.
